{"id":216,"date":"2022-03-07T09:41:00","date_gmt":"2022-03-07T09:41:00","guid":{"rendered":"http:\/\/jthemes.org\/wp\/shiftkey\/2019\/06\/01\/a-augue-suscipit-luctus-purus-an-ipsum-neque-copy\/"},"modified":"2022-03-08T17:39:35","modified_gmt":"2022-03-08T17:39:35","slug":"munca-la-subdeclarata-sanctiuni-pentru-intarzierea-platii-salariilor","status":"publish","type":"post","link":"https:\/\/halmi-expert.ro\/salarizare-personal\/2022\/03\/07\/munca-la-subdeclarata-sanctiuni-pentru-intarzierea-platii-salariilor\/","title":{"rendered":"Amenzi pentru angajatorii care \u00eent\u00e2rzie plata salariilor \u0219i pentru munca subdeclarat\u0103, \u201cla gri\u201d"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\"> <\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"http:\/\/legislatie.just.ro\/Public\/DetaliiDocument\/246897\"><strong>OUG nr.117\/2021<\/strong><\/a>, care va intra \u00een vigoare \u00een data de\u00a0<strong>20 octombrie 2021<\/strong>, introduce \u00een Codul Muncii, no\u021biunea de<strong>\u00a0munc\u0103 subdeclarat\u0103, \u201cla gri\u201d,\u00a0<\/strong>instituie\u00a0<strong>amenzi\u00a0<\/strong>pentru angajatorii care\u00a0<strong>\u00eent\u00e2rzie plata salariilor cu mai mult de o lun\u0103\u00a0<\/strong>\u0219i extinde de la 60 de zile la\u00a0<strong>90 de zile\u00a0<\/strong>termenul de compensare a\u00a0<strong>muncii suplimentare<\/strong>\u00a0prin zile libere pl\u0103tite.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"> <\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Sanc\u021biuni:<\/h4>\n\n\n\n<ul class=\"wp-block-list\"><li><em><strong>acor<\/strong><\/em><strong>darea unui salariu net mai mare dec\u00e2t cel \u00eenregistrat \u00een statele de plat\u0103<\/strong>\u00a0\u0219i declarat prin declara\u021biile fiscale aferente, se sanc\u021bioneaz\u0103 cu\u00a0<strong>amend\u0103 de la 8,000 lei la 10,000 lei\u00a0pentru fiecare salariat\u00a0<\/strong>identificat \u00een aceast\u0103 situa\u021bie, f\u0103r\u0103 a dep\u0103\u0219i valoarea cumulat\u0103 de 100,000 lei;<\/li><\/ul>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>primirea la munc\u0103 a unuia sau a mai multor salaria\u0163i cu dep\u0103\u0219irea duratei timpului de munc\u0103<\/strong>\u00a0stabilit\u0103 \u00een cadrul contractelor individuale de munc\u0103\u00a0<strong>cu timp par\u0163ial<\/strong>\u00a0este sanc\u021bionat\u0103 contraven\u021bional, cu\u00a0<strong>amend\u0103 de la 10,000 lei la 15,000 lei pentru fiecare persoan\u0103\u00a0<\/strong>astfel identificat\u0103, f\u0103r\u0103 a dep\u0103\u015fi valoarea cumulat\u0103 de 200.000 lei.<\/li><\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"> <\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Amenzi pentru angajatorii care \u00eent\u00e2rzie plata salariilor<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Noua reglementare introduce \u0219i&nbsp;<strong>amenzi pentru angajatorii care \u00eent\u00e2rzie plata salariilor cu mai mult de o lun\u0103 de zile&nbsp;<\/strong>ulterior datei de plat\u0103 agreat\u0103 \u00een contractul individual de munc\u0103.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Sanc\u021biuni<\/h4>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Sanc\u021biunea aplicabil\u0103<\/strong>\u00a0este de la\u00a0<strong>5,000 lei la 10,000 lei<\/strong>\u00a0<strong>pentru fiecare persoan\u0103<\/strong>\u00a0<strong>c\u0103reia nu i s-a pl\u0103tit salariul<\/strong>.
